Senate Bill 62 prohibits Arkansas public entities—including state agencies, local governments, and public schools—from entering into contracts for goods, services, information technology, or construction with companies that engage in a 'boycott' of the energy, fossil fuel, firearms, or ammunition industries. A boycott is defined as refusing to deal with or terminating business activities with these industries for reasons other than ordinary business purposes, specifically excluding actions taken solely for social, political, or ideological interests. Companies entering into contracts must provide written certification that they are not currently boycotting these industries and will not do so for the duration of the contract. The bill provides exceptions for contracts valued at less than $75,000 and for companies that offer to provide goods or services at a price at least 20% lower than the lowest-bidding company that certifies compliance with the law.
