House Bill 1237 prohibits Arkansas medical professionals and their agents from soliciting individuals who have recently sustained injuries from accidents, disasters, or other events. Solicitation is defined as communication via phone, text, internet, or in-person contact. Exceptions are granted if the professional has a pre-existing family or professional relationship with the individual, or if the solicitation occurs more than thirty days after the incident. Violations are classified as Class D felonies and are also deemed deceptive trade practices. The bill renders any agreements for healthcare services resulting from prohibited solicitation invalid and unenforceable, while requiring refunds for any payments made. Furthermore, it establishes a private cause of action for victims to recover pecuniary losses, costs, and attorney’s fees, with additional statutory damages.
