Senate Bill 406 amends Arkansas law regarding the recording of real estate deeds to improve verification procedures. It mandates that a grantor or an individual signing on behalf of a grantor must present a valid state or federal photo identification to the county recorder when filing a deed. If submitted in person, the grantor must appear at the recorder's office; if submitted by mail, a photocopy of the identification must be included. Recorders are required to file these identification documents under seal. However, the bill provides numerous exemptions for professional entities and government officials, including attorneys, real estate brokers, title insurance agents, banks, and government agencies. The primary purpose is to add an additional layer of security against fraudulent property transfers.
